In the case of Gorgiladze v Georgia the applicant alleged the violation of Articles 3 and 6 § 1 of European Convention for the Protection of Human Rights and Fundamental Freedoms. The European Court of Human Rights in its judgment of 20 October 2009 found violation of  Articles 3 and 6 § 1 of European Convention for the Protection of Human Rights and Fundamental Freedoms and obliged the respondent State to pay 5,000 euros as non-pecuniary damage.
